CLOMOSY TERMS OF SERVICE & ACCEPTABLE USE POLICY

Welcome to Clomosy. These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between Atiker Yazılım Veri İşlem A.Ş. ("Company", "We", "Our", "Us", or "Clomosy") and the registered user, developer, or authorized corporate entity ("User", "Developer", "You") accessing or using the Clomosy mobile application ("Clomosy Mobile Workspace"), web development portals, APIs, and associated cloud services (collectively, the "Services").
By registering an account, downloading the mobile application, or accessing any part of the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.
1. NATURE OF SERVICES & WORKSPACE RUNNER
- Platform Definition: Clomosy provides a companion mobile workspace client and execution runtime engineered for software developers and enterprise teams to preview, test, and run declarative UI layouts, forms, and business logic created on the Clomosy development platform.
- No Open Storefront: Clomosy is not an open public app marketplace, digital storefront, or uncurated app distribution system. Access to workspace projects is strictly restricted to authenticated accounts and authorized collaboration invitations.
- Sandboxed Interpretation: The mobile client renders project interfaces through an embedded, sandboxed declarative engine without downloading, installing, or executing external compiled native binaries (.dex, .apk, .dylib, .so).
2. ACCOUNT REGISTRATION & SECURITY
- Eligibility: You must be at least 18 years of age and possess the legal authority to enter into binding agreements. If registering on behalf of a corporate entity, you warrant that you are fully authorized to bind that entity.
- Credential Protection: You are solely responsible for safeguarding your login credentials, passwords, and project access tokens. You agree to notify Clomosy immediately at [email protected] upon discovering any unauthorized access or security breach.
- Account Non-Transferability: User accounts are personal and non-transferable. You may not sell, lease, share, or assign your account to any third party.
3. ACCEPTABLE USE & DEVELOPER OBLIGATIONS
When developing, testing, or executing projects through Clomosy, you agree to:
- Comply with all applicable local, national, and international laws, regulations, and third-party rights.
- Test and execute only projects, scripts, and schemas for which you hold valid intellectual property rights, licenses, or explicit owner authorizations.
- Ensure that any test datasets or mock credentials used within your workspace projects do not violate privacy rights, trade secrets, or data protection laws.
4. PROHIBITED CONTENT & CONDUCT
Users are strictly prohibited from creating, uploading, testing, hosting, distributing, executing, or facilitating any project, form, script, or asset that:
- Malicious Code: Contains viruses, trojans, worms, logic bombs, spyware, keystroke loggers, credential harvesting scripts, or unauthorized network exploitation mechanisms.
- System Circumvention: Attempts to bypass mobile sandbox restrictions, reverse engineer the native runtime engine, gain unauthorized root access, or decompile platform binaries.
- Infringing Material: Violates third-party copyrights, trademarks, trade secrets, patents, or moral rights without verifiable written license.
- Unlawful or Harmful Content: Contains, links to, or promotes sexually explicit material, hate speech, harassment, defamation, fraudulent schemes, unauthorized financial gambling, or illegal activities.
- Platform Overload: Conducts denial-of-service (DoS) attacks, automated bot scraping, excessive uncoordinated API polling, or actions that degrade service stability.
5. ABUSE REPORTING & UNILATERAL TAKEDOWN RIGHTS
To ensure platform integrity and store policy compliance, Clomosy enforces a strict zero-tolerance policy against prohibited activities:
A. Abuse Reporting Mechanism
Any user, enterprise partner, or third party who identifies a project or content violating this Agreement may report the violation directly to our security team:
B. Unilateral Content Removal & Modification Rights
Clomosy reserves the absolute, unilateral right, exercisable at its sole discretion and WITHOUT prior notice, liability, or consent from the project creator, to:
- Instantly unpublish, disable, restrict, block, or permanently delete any project, form, layout schema, script, or dataset that violates platform rules, store guidelines, or applicable laws.
- Revoke active project invitation codes and terminate access for all linked collaborators.
C. Account Suspension & Termination
Clomosy reserves the right to immediately suspend, restrict, or permanently terminate the account of any developer or user who engages in prohibited conduct, violates security boundaries, or receives validated abuse reports.
6. INTELLECTUAL PROPERTY RIGHTS
- Clomosy IP: All software, mobile runtime engines, interpreter code, UI frameworks, brand assets, logos, domain names, APIs, and documentation are the exclusive intellectual property of Atiker Yazılım Veri İşlem A.Ş.
- User Project Ownership: You retain full ownership and intellectual property rights over the custom business logic, proprietary scripts, and unique form structures you independently author on the platform.
- Limited Execution License: By uploading or testing projects on Clomosy, you grant Clomosy a limited, worldwide, non-exclusive, royalty-free license solely to host, parse, transmit, and execute your project schemas within your authorized workspace environment.
7. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY
- "As-Is" Provision: The Services and mobile workspace runner are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory.
- No Guarantee of User Project Logic: Clomosy is not responsible for errors, crashes, data corruption, or functional flaws arising from user-authored scripts, misconfigured form schemas, or external API endpoints.
- Limitation of Liability: To the maximum extent permitted by applicable law, Atiker Yazılım Veri İşlem A.Ş. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption, arising out of your use or inability to use the Services.
- Indemnification: You agree to defend, indemnify, and hold harmless Clomosy, its parent company, affiliates, directors, and engineers from and against any third-party claims, liabilities, damages, and legal expenses resulting from your project content, code, or violation of these Terms.
8. ACCOUNT CLOSURE & DATA DELETION
- You may terminate your account at any time via the in-app deletion mechanism (Settings > Account > Delete Account) or by submitting a written request to [email protected].
- Upon verified deletion, all user data, authentication credentials, and private workspace projects will be permanently wiped from active systems within 30 calendar days in accordance with our Privacy Policy.
9. GOVERNING LAW & JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye. Any dispute, controversy, or claim arising out of or relating to these Terms, the mobile application, or platform operations shall be subject to the exclusive jurisdiction of the Central (Çağlayan) Courts and Execution Offices of Istanbul, Türkiye.

İşbu Clomosy Kullanım Koşulları ("Koşullar", "Sözleşme"), Atiker Yazılım Veri İşlem A.Ş. ("Şirket" veya "Clomosy") tarafından işletilen Clomosy mobil uygulaması ("Clomosy Mobile Workspace"), geliştirici panelleri, API'lar ve bağlantılı dijital servislerin (birlikte "Platform") kullanımına ilişkin genel kural ve şartları belirler.
Platform üzerinde hesap oluşturan, mobil uygulamayı indiren veya servisleri kullanan tüm kullanıcılar ("Kullanıcı", "Geliştirici") işbu Koşulları ve Gizlilik Politikası'nı kabul etmiş sayılır.
1. PLATFORMUN NİTELİĞİ VE İSTEMCİ MODELİ
- Hizmetin Tanımı: Clomosy, yazılım geliştiricilerin ve yetkili ekiplerin kendi oluşturdukları formları, arayüzleri ve iş akışlarını mobil cihazlarda anlık olarak test etmelerini sağlayan bir geliştirici çalışma alanı ve test istemcisidir (workspace runner).
- Açık Pazar Yeri Değildir: Clomosy, halka açık kontrolsüz bir uygulama mağazası veya pazar yeri değildir. Projelere erişim yalnızca yetkilendirilmiş hesaplar ve özel katılım kodları üzerinden sağlanır.
- Sandbox Çalışma Mantığı: Mobil istemci, projeleri cihaz dışından derlenmiş çalıştırılabilir ikili dosya (.apk, .dex, .dylib, .so) indirmeksizin, yerel bileşenlere bağlı güvenli bir sandbox ortamında yorumlayarak çalıştırır.
2. HESAP GÜVENLİĞİ VE ÜYELİK
- Ehliyet: Gerçek kişi kullanıcılar en az 18 yaşında olduğunu; tüzel kişi adına işlem yapanlar ise ilgili kurumu temsil ve ilzama yetkili olduğunu beyan eder.
- Şifre ve Erişim Güvenliği: Kullanıcı, hesap giriş bilgilerinin ve proje erişim kodlarının gizliliğinden bizzat sorumludur. Yetkisiz bir kullanım tespit edildiğinde derhal [email protected] adresine bildirim yapılmalıdır.
- Hesabın Devredilemezliği: Kullanıcı hesapları kişiye/kuruma özel olup üçüncü kişilere devredilemez, kiralanamaz veya satılamaz.
3. YASAKLI FAALİYETLER VE İÇERİK KURALLARI
Platform üzerinde aşağıdaki nitelikteki projelerin, formların, scriptlerin veya materyallerin oluşturulması, yüklenmesi, test edilmesi veya paylaşılması kesinlikle yasaktır:
- Zararlı Yazılımlar: Virüs, truva atı, casus yazılım, kimlik avı (phishing), şifre çalma scriptleri veya cihaz güvenliğini bozan kodlar barındırmak.
- Sistem Güvenliğini Aşma: Mobil sandbox sınırlarını aşmaya çalışmak, istemci motoruna tersine mühendislik uygulamak veya platform kaynak kodlarını kopyalamak.
- Hak İhlalleri: Üçüncü kişilere ait telif, marka, patent, ticari sır veya kişisel verileri izinsiz kullanmak.
- Hukuka Aykırı İçerik: Müstehcen, hakaret içeren, yasa dışı bahis/kumar teşvik eden, dolandırıcılık amaçlı veya kamu düzenine aykırı içerikler barındırmak.
- Sistem Güvenliğini Tehdit: DoS saldırıları, izinsiz otomatik bot/scraping faaliyetleri yürütmek.
4. BİLDİRİM VE TEK TARAFLI İÇERİK KALDIRMA YETKİSİ
- Kötüye Kullanım Bildirimi: Platform kurallarına veya yasalara aykırı bir proje tespit eden herkes, proje kodunu ve delillerini [email protected] veya [email protected] adresine bildirebilir.
- Tek Taraflı Kaldırma Yetkisi: Clomosy; mevzuata aykırılık, üçüncü kişi hak ihlali, mağaza politikası ihlali veya güvenlik riski tespit ettiği hallerde, proje sahibinin önceden rızasını veya onayını almaksızın ve hiçbir bildirim yükümlülüğü bulunmaksızın, ilgili projeyi, formları veya kodları derhal yayından kaldırma, erişimini engelleme ve silme hakkına sahiptir.
- Hesap Askıya Alma / Kapatma: Yasaklı faaliyetlerde bulunan kullanıcıların hesapları geçici olarak dondurulabilir veya tek taraflı olarak kalıcı olarak kapatılabilir.
5. FİKRİ MÜLKİYET VE SORUMLULUK SINIRI
- Platform Mülkiyeti: Clomosy mobil istemcisi, çekirdek yorumlayıcı motoru, marka, logo ve teknik dokümantasyon üzerindeki tüm fikri mülkiyet hakları Atiker Yazılım Veri İşlem A.Ş.'ye aittir.
- Kullanıcı Projeleri: Kullanıcı tarafından platformda bağımsız olarak yazılan iş mantığı ve form tasarımlarının mülkiyeti kullanıcıya aittir.
- Sorumluluk Reddi: Clomosy, kullanıcıların geliştirdiği projelerdeki kodlama hatalarından, veri kayıplarından veya üçüncü taraf API aksaklıklarından sorumlu tutulamaz.
- Tazminat ve Rücu: Kullanıcının geliştirdiği içerikler nedeniyle Clomosy'nin herhangi bir idari para cezası, tazminat veya yasal yaptırımla karşılaşması halinde, ilgili kullanıcı doğan tüm zararı tazmin etmekle yükümlüdür.
6. HESAP SİLME VE SÖZLEŞMENİN FESHİ
- Kullanıcı dilediği zaman uygulama içerisinden (Ayarlar > Hesap > Hesabı Sil) veya [email protected] adresine e-posta göndererek hesabının ve verilerinin silinmesini talep edebilir.
- Talep üzerine, kullanıcının hesabı ve özel projeleri 30 takvim günü içinde aktif veritabanlarından kalıcı olarak silinir.
7. YETKİLİ MAHKEME VE UYGULANACAK HUKUK
İşbu Sözleşme Türkiye Cumhuriyeti kanunlarına tabidir. Sözleşmenin uygulanmasından ve Platform kullanımından doğabilecek her türlü uyuşmazlığın çözümünde İstanbul Merkez (Çağlayan) Mahkemeleri ve İcra Daireleri münhasıran yetkilidir.
